1. Service Description

EscrowReply provides an automated lead response system for residential real estate agents. Our service sends SMS and email communications to real estate leads on behalf of licensed agents, with the goal of improving response time and lead qualification.

2. Agent Responsibilities

Agents using EscrowReply agree to:

Only use the service for leads who have legitimately inquired about real estate services
Ensure all leads have provided consent to be contacted through the originating listing platform
Comply with all applicable laws including the TCPA, CAN-SPAM, and state real estate regulations
Not use the service for unsolicited marketing or spam
Maintain accurate and up-to-date account information

3. SMS Messaging Terms

EscrowReply's SMS program operates as follows:

Messages are sent to leads who have submitted contact information through real estate listing platforms
Message frequency depends on lead activity and agent configuration, typically 1–5 messages per lead inquiry
Message and data rates may apply based on the recipient's mobile carrier plan
Recipients may opt out at any time by replying STOP
Recipients may request help by replying HELP

4. Prohibited Uses

You may not use EscrowReply to:

Send messages to individuals who have not consented to be contacted
Engage in deceptive, misleading, or fraudulent communications
Violate any applicable federal, state, or local law or regulation
Harass, threaten, or harm any individual

5. Service Availability

EscrowReply provides its service on an "as is" basis. We do not guarantee uninterrupted service and are not liable for any delays in message delivery caused by third-party carriers or platforms.

6. Limitation of Liability

EscrowReply's liability is limited to the amount paid for the service in the month in which any claim arises. We are not liable for indirect, incidental, or consequential damages.

7. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.
